Selling your house

Selling a property can feel like a minefield. You have to trust your estate agent that they have valued your home correctly, and that they will be able to find the perfect buyer. There are many moving parts in a property sale, so we like to make sure the legal side of things is as straightforward as it can be.

We will take the time to explain our processes and the legal requirements of the sale, and we will make sure you are comfortable every step of the way. Our dedicated team are all experienced and we will try and maintain a single main point of contact throughout. Relationships and trust matters when you’re selling your home, and we understand that. It’s why we pride ourselves on a friendly service with a transparent fee structure. We go the extra mile, handling all negotiations with your buyers legal team and liaising with your estate agents wherever possible to keep the process as pain free as possible.

Purchasing a property

Buying a property is usually the single most expensive decision you will make. Protecting your investment and making sure all the legal searches and requirements are met is our job and we will guide you through every step, explaining the expected timeframes and what’s happening at any given point.

Often, you will be selling at the same time as buying, meaning you are part of a chain of several homeowners, all trying to complete and move on the same day. Our experienced team will lead the process and keep you fully informed at every stage so there are no unwelcome surprises and when it’s time to collect the keys to your new home, you are ready to enjoy the next stage of your life.

Remortgaging your home

Not every conveyancing job includes buying or selling. Often when your mortgage rate comes to an end, your existing provider will make you a strong offer to keep your business with them, but equally it can be time to move to a different lender with a more competitive product. If this is the case, then you will need a team of professionals to handle the legalities of remortgaging – moving your loan to a new provider and paying off the existing lender.

While this process can be a lot simpler than a sale or a purchase, there are still steps that need to be taken and legal requirements to complete. Drew Property Law will take care of everything on your behalf, liaising with your existing and new lenders to ensure a smooth transition.

Leases

Most houses will be sold on a freehold basis but often flats and apartments are sold on a leasehold basis, meaning another person or company owns the freehold of the building. In these situations, there are legal requirements, and also requirements stipulated by mortgage providers, on the terms of the lease. Most commonly, how long a lease has to run.

Most mortgage lenders like to see a lease term remaining of at least 80 years, so anything that is within or close to this marker means we need to have a conversation about extending the lease before a purchase can be made if using a mortgage provider.

Not all lenders have the same criteria, so it’s worth keeping in that in mind, but extending the lease can pay off in the long term as it will make selling your leasehold property easier.

Declarations of Trust

If you’re purchasing a property with a friend or a partner who you aren’t married to, you might want to consider a declaration of trust. In simple terms, a declaration of trust is a legal document that details the precise ownership of a property, including the percentage split if it is not even, and what happens when the property is sold or one party passes away.

While many may see this as unimportant, it really is a system that protects both parties and should not be ignored. It isn’t an onerous process, and our team of experienced conveyancers can guide you through it and make sure everyone’s interests are protected for any eventuality.

Declarations of trust can also be used to protect inheritance if one or both partners have children from a previous relationship. It really is a flexible way of ensuring your wishes are followed should the worst happen.

The peace of mind from knowing that you and those you care about are protected from whatever the future may hold can be very comforting. Drew Property Law can help you achieve that.

Between them, our team has more than 50 years’ experience, so you can be assured that your sale, purchase or remortgage is in the best possible hands.
